Learn How to Use the French Preposition Par The French preposition par means through, by, or per in English. It is used to indicate the manner in which something is done, the reason behind an event, the direction something moves, or the amount of something per some unit of measurement. In everyday conversation, you might use par when giving directions to someone or to describe how an event occurred. Examples of Par Je suis sortie par la porte.I left through/by the door.Jai appris la verità © par hasard.I learned the truth by accident.Il la obtenu par la force. He obtained it by force.Je lai envoyà © par la poste.I sent it through the mail.Il a jetà © les dà ©chets par la fenà ªtre.He threw the garbage though/out the window.Il gagne 500 euros par semaine. He earns 500 euros per week.Par is often used to introduce the agent in the passive voice:Ce livre, à ©crit par Voltaire...This book, written by Voltaire...La tasse a à ©tà © cassà ©e par un chien. The cup was broken by a dog. Why Crowdsourcing Sometimes Works for Writers

Why Crowdsourcing Sometimes Works for Writers Years ago when someone needed a writer, that person went through a marketing firm or relied on queries received after a call for submissions. In today’s â€Å"sharing economy,† writers can be found on the Internet easily, alongside people offering to design a company’s logo for $5 and manage entire marketing campaigns for $20. Unfortunately, this has led professionals to assume that the sharing economy is for amateurs. As someone who earned half her income last year through Elance, I’m here to tell you that professional writers do have a place in crowdsourcing. Businesses of all sizes use these sites to find talent and some of those businesses are eager to pay professional rates. If you’ve dismissed crowdsourcing as a way to supplement your freelance writing income, here are three reasons to reconsider: It’s a Great Supplement Even the busiest freelancer has slumps. One week your inbox is full of assignments and the next, you’re wondering if you’ll ever work again. Crowdsourcing gives you an option when it feels like all the editors have flown off to a tropical island somewhere. You can place a few proposals and maybe land an assignment or two. A couple of those assignments may even lead to ongoing work. The cost to join these sites and start bidding on jobs is minimal, so the only real cost is the time you’ll put into searching through all the requests for bids. Experts Can Be Choosers Before you sign up and begin searching for jobs, be aware that if you command a high per-word rate, you must learn to be selective. You’ve probably already discovered how to identify the low payers through their use of terms like, â€Å"Great opportunity to build your portfolio† and, â€Å"We don’t have a big budget, but we promise plenty of work.† Many of your proposals may be met with complete silence. But if you’re willing to put in the time, you can find clients who will pay your rate. Finding Your Niche Many freelancers learn that having a niche allows them to set themselves apart from others. Medical writers can command top dollar, as can those willing to write about science and technology. In the crowdsourcing arena, you’ll likely find that postings for articles and blogs are highly competitive, which means clients can pay ridiculously low rates. However, clients are willing to pay far more for important content, and you’ll discover that you can bid top rates for landing page content, sales copy, and press releases. Focus on these areas and you’ll avoid wasting time bidding on jobs requesting 20 articles about wedding dresses. Due to the competitive nature of crowdsourcing, many freelancers quickly get frustrated with the work required to successfully bid on jobs. However, when funds are low and jobs are scarce, crowdsourcing can provide a valuable source of income and possibly lead to regular, reasonable-paying, maybe even long-term work. If you’re ready to get started with crowdsourcing, here are some of the best sites to find writing gigs: Elance Guru Outsource PeoplePerHour Freelancer

Why Do Teachers Plan Their Lessons Why is Planning Important Coursework

Why Do Teachers Plan Their Lessons Why is Planning Important - Coursework Example For a teacher to make a good lesson plan, it is necessary that he reflect on what the need of the students in that particular lesson will be so that he can be able to accommodate them in his plan. Although educationalist regards lesson planning as very important in ensuring an effective teaching a learning process during a lesson, some theorists suggests that it is not a good idea since it creates a more fixed teacher centered lessons thus reducing the chance of the students understanding (ITTT 2011). The reasons why lesson planning is an important task can be revealed by looking at the way in which the lesson plan helps the three categories of people involved in a learning process. These three categories of people include the students, the teachers and the principals and supervisors. These three categories of people derive different benefits when a lesson plan is used during a lesson. The reasons for the importance of the lesson plan contributed by its benefits to other people rathe r than the teacher himself who is making it can be regarded as external reason while those that result from the benefits that the teacher himself would gain can be regarded as internal reasons. ... As indicated by previous researches the teachers who prepare the lesson plans always go to class with a better understanding of what they are going to teach compared to those who do not. It also indicates that the teachers who use lesson plan are able to obtain a wide range of knowledge about the subject matter in which to teach about before undertaking the lesson. This enables this kind of teachers to be able to run the teaching process effectively and thus enhancing the learning process among their students. The lesson plan also enables the lesson to run smoothly. Since in a lesson plan each activity is allocated its time a teacher can easily be able to ensure that the lesson is ran smoothly without major interruptions. Moreover, since the activities in a lesson plan are sequentially arranged a lesson plan can help a teacher to avoid running his lesson in a confused manner thus increasing the effectiveness of his teaching process. When the teaching process is run in an orderly and smooth manner, the learning process among the students is enhanced and thus resulting to a greater understanding among the students about the subject matter being taught. Another internal reason why a lesson plan is important is that it can enable a teacher to anticipate problems before they happen. If a lesson plan is well prepared, it is believed that it can enable the teacher to reflect about what problems he anticipates to encounter during a lesson. This is because it reflects on the past such lesson that the teacher held with those particular student, what was achieved in those lesson and the problems that were encountered. When the teacher is able to

Reflection of how I have put principle of nursing - principle E Essay

Reflection of how I have put principle of nursing - principle E effective communication into practice in the placement - Essay Example When I began to inculcate Principle E in my practice, the strongest motivator to do so was poor patient outcomes. Communication difficulties affect patient outcomes (Casey & Wallis 2011, p. 35). So, when things started going wrong, I used Principle E to control situation. The most important concern for me when I started to use Principle E was related to lack of confidence among nurses. I noticed that my fellow nurses lacked basic skills of communication which restricted them from confidently reporting patient information to doctors. Because there was no confidence in their reporting, there was also the problem of poor documentation. Reporting and documentation should be both perfectly clear to improve patient outcomes because they directly affect patient health (Bell & Jones 2007, p. 487). I realized that communication difficulties were at the root of both problems. This practical experience helped me in getting acquainted with the efficacy of Principle E. Patients report dissatisfaction with the way they are provided care when errors are not reported by nurses. Fear inhibits reporting (Barnsteiner 2011). I noticed that without proper implementation of Principle E, patient privacy also becomes a big concern. This is because I came across breaches in patient confidentiality sometimes, but tracking them down revealed to me that they never got reported. This was due to unprofessional execution of duties. I used Principle E to solve this problem because it stresses that patient information should be handled very sensitively and discreetly (Casey & Wallis 2011, p. 36). It is the subtle deficiencies in the way we communicate which go on to present the biggest challenges to nurses. There are confusions and misunderstandings. I dealt with them by practicing Principle E in accordance with NMC standards. For example, one NMC standard promotes that a nurse should become an advocate for people in his/her care and should hasten to

Nietzches Moral and Political Philosophy Essay Example for Free

Nietzches Moral and Political Philosophy Essay In Nietzches Moral and Political Philosophy Nietzches theory of the strong and weak willed is explained to us. Nietzsche â€Å"seems to want to say that anyone who is strong, independent, and so on — anyone who fits his description o the higher type of man — is one who has value in himself†. I think it is interesting that Nietzsche puts such high value on a man who can think for himself, but if this man has followers and admirers of his work, these followers are considered weak willed. If everyone in the world thought for himself and broke free of the society accepted norms, our World would be one of mad chaos. Nobody believing each other or taking another mans word, everyone having to find out for themselves, and everyone trying to rise above another to break free from societal norms. Although it should be praised when a man has a strong will to power and can break free from the common attitudes and beliefs, i do not believe this path of master morality is something every man should do. Nietzsche seems to place a much higher value on a man that breaks free of society, and says the followers shape everything in society to work against this man,â€Å"[m]oral judgments and condemnations constitute the favorite revenge of the spiritually limited against those less limited† (BGE 219), and he claims that the â€Å"chief means† by which the â€Å"weak and mediocre†¦weaken and pull down the stronger† is â€Å"the moral judgment†. To better understand this you could say, that the Government (the weak willed) put restrictions on citizens to get them to conform to societal norms. The goal of this is to weaken the citizens and prevent them from rising above the government. In the example I used above I would [Type text] [Type text] [Type text] argue to Nietzsche that in rising above this weak willed government in order to become a strong willed person, could mean i am breaking laws and harming others in order to fit in the master morality category. How would he explain criminals who break free of societal norms and attitudes but do it by unjust means? I think this theory of what a strong and weak willed man is, is very questionable. Although you should aspire to question what you are taught and common beliefs are, i dont believe all men who do this are strong-willed.

Computer Engineering :: essays research papers

Computer Engineering Choosing a career is very important in a person’s life. Over the past two decades, many professions have change significantly with the influx of technological developments. One needs to think about the things that interest them and what kind of lifestyle they want to have. Some things a person should think about are what qualifications are needed, what type of training is necessary, and the future need of the career they choose. Some other things to consider would be how much money they will make, what is the probability of advancement, and does the career satisfy their need for an enjoyable life. One career in the technological industry is a computer engineer. A computer engineer is a person who designs hardware or software for computers. Computer engineers do research to determine what people want and need to make their lives easier. Computer engineers sometimes work on a team to think of new ideas and concepts. Engineers generally should like activities of a technical nature, problem solving, and math. An engineer should probably like working with numbers and thinking logically. A computer-engineering career requires the most education of any career in the computer industry. Some school subjects that are helpful in preparing a person who wants to become a computer engineer are algebra, geometry, calculus, trigonometry, computer science, and English. Computer engineers need to be able to think logically, communicate ideas clearly, and work well in a team environment. To become a computer engineer a degree in computer science, engineering, or physics is required. Computer engineers spend an extended amount of time typing. A computer engineer should also expect to work long hours and enjoy working with new ideas and concepts. Becoming a proficient typist would be something to consider when a person is interested in becoming a computer engineer. In 1947 Howard Aiken, an engineer, predicted six computers would satisfy the computing needs of the U.S. By the year 1955, 244 computer systems were in use and by 1984 U.S. businesses and individuals purchased over two million personal computers. By 1994, shipments of over 47 million personal computers were made worldwide. The use of personal computers has increased rapidly over the past half-century and therefore the need for new hardware and software will keep the need for computer engineers to continue producing new products. The first position for a person becoming a computer Engineer is a Junior Computer Engineer.

Lower class

Lower class Americans do not often discuss the class separation that exists in today's society, but we all know there Is something going on. The government helps supports the lower class, so that the lower class can also enjoy their lives without having to work. DRP. Daniels analysis about the underclass and Its relationship to the government Is accurate based on poverty, criminality, and family fluidity. One of the aspects that allow the lower class to remain in their specific position is because of poverty.A lot f the time, the lower class will not take the initiative to work because they claim to get â€Å"paid†. As Anthony Daniels quotes â€Å"l get paid on Friday(Daniels), they are not actually getting paid but rather are receiving state benefits and feel entitled to have them without doing any work. The correct term they should be using is â€Å"I received my check on Friday'. And for this reason the lower class does not feel necessary to work since they receive a chec k every Friday. So, what happens if they do decide to work?Well, when and if they do decide to work, they will usually end up regretting It. The US Government Is basically saying we had destroyed all economic incentive for the latter to work† (Daniels). Here In the US, If you start making more than a certain amount of Income, all your states benefits will get cut-off. This concept Is super deadly because they still need support and are still struggling to become volcanically well. Lastly, the lower class does not think about the future. Most of the time, they ill be concerned with paying of bills (living on a day to day basis), or spending it all on the spot for luxurious items. Many successful people know that saving for the future is exceedingly important and truly beneficial for them. Criminality in the lower classes is a choice that can be steered clear of. Committing crimes for drugs is something that happens quite often and here is the reason why â€Å"Dishonest passivit y and dependence combined with harmful activity becomes a pattern of life, and not just among drug addicts. † (Daniels).Basically committing crimes has become a way of life not only for drugs, but also for other needs. It's not that cannot stop committing crimes but they need help getting out of this villous cycle. These days, there Is no such thing concept of a traditional' family anymore. â€Å"Everyone lived In households with a shifting cast of members, rather than in families. † (Daniels) I really agree with this statement, because today we have no such thing as a family anymore due to divorce rates. Parents are constantly arguing and in disagreement and their children eve no idea what to do.So these children often look up to the TV because that's the one thing they can find satisfaction in. Another reason why these families are so dysfunctional is due to work. Often the father will leave the mother all alone to take of their children all by herself. This mother of ten will have two Jobs, working day and night, to support her children because she is a single parent. This also brings up another point of why families are dysfunctional Is due to Individualism. Many Americans believe In the Idea of individualism which can be bad.In the article, the following quote Is the new definition of Individualism: â€Å"Mothers would say to me that they were pleased to be Independent, by which they meant Independent of the fathers† (Daniels). Usually these mothers are free of the ruthless fathers, but rather government for help. In today's society we all maybe considered equal, but subconsciously we all know that social classes influence our decisions. It is near to impossible to break out of your social class because the government has a system set into place that nearly affects everyone.

America Movil †The Jaguar’s Next Move

After a deep analysis of the strengths and weaknesses of America Movil, and considering the forces that are currently driving the growth of the wireless telecom market in Latin America and the rest of the world, we have elaborated certain recommendations concerning the company’s future strategic decisions which, in our opinion, should be considered in order to consolidate the corporation’s current position as a global leader in this industry.Regarding the issue of the possible expansion of America Movil into new markets; the analysis shows that the best strategy for the company to follow, considering its current investments, assets and the forecasts for each region, is to focus on the organic growth and to continue strengthening its position in the Latin American market, where the corporation has been able to develop strong brand awareness among the consumers and where the cultural, social and economic aspects of the region represent an advantage against competitors.Reg arding the possibility of a future merge between America Movil and Telmex International, there is no doubt that the synergy that both companies could generate is enormous, nevertheless, due to the basic yet significant differences in these telecom segments, the best option is to keep both companies as separate entities while allowing them to work together by the establishment of joint ventures and strategic alliances in specific projects. Sincerely Yours, Author Organic Growth against Positioning in New MarketsAfter quite a long â€Å"shopping spree† that lasted over seven years, from 2000 to 2007, in which America Movil invested and acquired assets all over Latin America, becoming the largest and most powerful corporation in the region; today the company needs to decide whether to continue its expansion through acquisitions – either in the same region or in different potential markets such as Europe or Asia – or to settle down and focus on getting the most out of its current investments. To determine which of these options brings the most benefits for America Movil, we will analyze several aspects of the company and the environment in which it competes, as well forecasts, opportunities and threats that come with each one of these options. Analysis of America Movil and its current position in the Latin American MarketAmerica Movil currently holds a privileged competitive position in the Latin American Market, with strong presence in 16 different countries that at the same time, share a wide variety of cultural, economical and social aspects. These common characteristics represent an advantage for America Movil against foreign competitors due to the experience and proven success of the company in positioning itself and understanding the dynamics in this region. Some of the countries in which the corporation competes, are currently in an advanced stage of development regarding the wireless market – such as Argentina, Chile, El Salvador and Uruguay, where the wireless percentage of penetration is above 85% of the population – while others represent an attractive opportunity of growth – such as Brazil, Colombia, Ecuador, Guatemala, Honduras, Mexico, Nicaragua, Paraguay, Peru and Puerto Rico – where the percentage of penetration ranges from 41% to 75% of the population. The impact of these percentages can be better appreciated in exhibit 1, where it shows that the total number of potential clients in the region can be assumed to be above 150 million, a number which exceeds the total number of customers currently affiliated with America Movil – 141 million-, especially in countries such as Brazil, Colombia, Mexico and Peru, where the company already has a relatively high percentage of the market share. The total number of potential customers just in these four countries is almost 130 million, 85% of the total number of potential customers. As important as the size of the market available for this corporation, is the distribution of revenue that each one of these countries represents. This distribution can be better appreciated in exhibit 2. What the trend is showing is that the percentage of revenue from Mexico, the most important market for America Movil, is decreasing compared to other countries in which the company operates. From 2004 to 2008 the participation of Mexico has reduced from 54% to 39%, meaning that over half of the revenue of the corporation today comes from its operations in foreign markets, emphasizing their increasing importance relative to the domestic market, which importance has decreased in over 15% while the Brazilian, Caribbean, Andean and Mercosur markets have rose between 4% and 7% each. However, as we can appreciate in exhibit 3, the overall behavior of the Latin American Market shows that it has been in an important phase of growth in the past 4 years, from 2004 to 2008, where revenues have increased over 151%.These numbers together support t he arguments of both, the strong position that America Movil currently has in the Latin American market, and of the success of the company in understanding the dynamics of the Latin American economy and culture; which translate in a competitive advantage over its main competitor in the region, Telefonica, and other European and North American based corporations that have struggled in positioning themselves in the countries where America Movil has established.Current Strategy in Latin America The success factors of America Movil strategy in this region can be summarized in two main categories; the penetration strategy and the positioning strategy. Penetration Strategy The penetration strategy developed by the company has been clear since the beginning; the acquisition of assets in the different Latin American countries for a low price. This strategy has benefited the corporation by providing them with the required infrastructure to operate at a relatively low cost, taking advantage of opportunities generated by the failure of other companies to develop a strong position in the market and taking advantage of the liberalization of the Latin American economies. Examples of these acquisitions are the purchase of BCP from BellSouth Corp. (USA) and Verbier (Brazil) in 2003 for $643 million and American Movil Peru from TIM International (Italy) for $503.4 million. The main reasons for the retreat of these companies from the region were either difficulties at their domestic markets or failed business strategies, two factors that America Movil had under control, with a strong domestic market performance in Mexico and with a profitable business strategy in the region. Positioning Strategy The second factor that drove the success of the corporation in the countries where it penetrated was the positioning strategy. The strategy to obtain a strong position in the markets where it competes was developed considering the economic situation of the majority of the Latin American p opulation, which is relatively weaker and more unstable and than the one in markets such as North America or Europe. With this in mind, America Movil developed a system of pre-paid cards, which to this date, has been the driving force of the company’s growth in the region. The advantage of this model lies in the fact that the corporation discovered that Latin Americans were more likely to become users of wireless communication services if they had the opportunity to pay for the service as they required it; avoiding long term contracts and potentially escalating debts, which, because of the unstable economical situation, could become impossible to pay.The customers were not the only ones beneficiated, since with this model, America Movil became able to considerably reduce collection costs and to avoid invoice defaults that on the long run, could have affected the revenues of the company as well as the number of their clients. There are, however, two main weaknesses in this mode l, the first one lying in the fact that this strategy can be relatively easily copied by its competitors and in the long run, it doesn’t represent a significant competitive advantage over them. The second disadvantage is that the revenues generated by this strategy are lower than the ones obtained by a post-paid model, which mean that its profitability is based on the volume. Nevertheless, this is currently not a problem for the company since over 83% of its customers are using the pre-paid option. Forecasts of the Wireless Market in Latin America As appreciated in exhibit 1, there are currently a huge number of unattended potential customers in the Latin American Market. This can be assumed by noticing that the overall penetration is 66%, with countries such as Argentina with an astonishing 97% penetration percentage while others important markets such as Brazil and Mexico are about 65%, a number that can be largely increased considering the pre-paid strategy used by America M ovil, which simplifies and encourages the use of its service among the population. As seen in exhibit 4, according to the case, the forecast for the year 2012 expects an increase from 66% to 76% in the number of subscribers in the wireless market; this represents an increase of almost 50 million new customers, which, as analyzed earlier, are mostly expected to come from four countries: Brazil, Colombia, Mexico and Peru, which combined, have a population of unsubscribed potential customers of almost 130 million, while all of the other countries barely reach 22 million. This information can help the company focus their efforts in the markets mentioned before, while maintaining a relatively stable growth in the others, focusing mostly not in attracting new customers but in increasing the profitability of each one of them. Analysis and Forecasts of the Wireless Market in the rest of the world After analyzing the benefits of focusing on the organic growth of the company, it is also importa nt to consider the option of expanding further into new non-natural markets for America Movil. The options available are the Asian, European and the Middle East/Africa and North American Market, where the company currently has a small operation. The main advantage of the Asian market is definitely its size; as the continent with the larger population, over 3,879,000,000 according to the World Atlas’ estimates of 2006, and over 10 times the population in South America; it’s definitely the most attractive market to consider. Nevertheless, there are two main barriers that might decrease the attractiveness of trying to penetrate in this market; the competitors and the enormous cultural differences between Asia and Latin America. The competition in Asia represent a huge threat for newcomers, since is the domestic market of China Mobile, the largest wireless corporation in the world with over $275 billion in revenue and the financial power to overwhelm any new entrant. In addi tion to this, the fact that, as in Latin America, America Movil is familiarized with the economic, social and cultural aspects of the population, China Mobile has a huge advantage and experience with the Asian culture.Europe is also another important market to consider, and the one that America Movil has been closer to penetrate in; however, the same problems arise, with the presence of Vodafone, a British corporation with over $152 Billion in revenue and the advantage of competing in a market in which the company is more familiar with. This in addition to the fact that, as stated in the case, Europe doesn’t seem to be ready to open to competitors from the new world, which mean that America Movil is going to have more trouble penetrating with its acquisitions strategy. Finally, North America doesn’t seem to be an attractive market due to its saturation and low expected growth of only 1. 2% and in the Middle East and Africa America Movil may end up making the same mistak es made by European and North American Corporations in Latin America, which is a weak positioning strategy. These are the reasons why the most feasible strategy is to focus on the organic growth, since the strengths that the company has in Latin America, specially the knowledge of the market, can become weaknesses when trying to expand to new markets where strong competitors already have the advantage of experience and economic power.Merger between America Movil and Telmex International The rapid technological changes in the telecommunications industry and the emergence of new players, combined with the reduction of traditional entry barriers and the rise of alternative service providers are forces that currently represent a huge threat for both America Movil and Telmex International. This is the reason why, taking advantage of being part of Carlos Slim’s Holdings, both companies should be able to establish synergy in the markets where they compete in order to offer a combina tion of services that would be more difficult, if not impossible, to provide by separate.Nevertheless, due to the significant differences in issues such as the infrastructure and strategies required to operate, a merger could not be the best option, however this doesn’t mean that both America Movil and Telmex International are not able to develop joint ventures or strategic alliances while working in specific project that might, in the long-term, increase their profitability, competitiveness and presence in the Latin American Markets.New trends in telecommunications such as the triple play which offers voice, date and video are rapidly acquiring popularity and obtaining an important share of the market, if Telmex International and America Movil can combine these with the wireless service, there is no doubt that they will obtain an important advantage in any of the countries where they establish.Cited Works Rullan, Samantha. What is the Purpose of Environmental Law Essays

What is the Purpose of Environmental Law Essays What is the Purpose of Environmental Law Paper What is the Purpose of Environmental Law Paper Significant developments in environmental law can be traced back to the 1800s; and dealt largely with public health concerns initially. [1]Only since the 1970s however, has ‘environmental law’ as a separate concept formed to tackle the objective of ‘sustainable development’. [2]Common law too has played an equally vital part in between these developments. [3]Indeed, the purpose of environmental laws from 1800s to present has shifted. [4]This shift in purpose shall be discussed, but firstly, taking into considerations the definitions of ‘purpose’,[5] ‘environment’,[6] and‘law’[7] ; the question shall be interpreted to ask – what the intention of the values are in law and policy, concerning the air, land, and water. Victorianenvironmental law reflected very muchthe concerns of ‘nuisances’[8] to public health. Industrialisation only accentuated these concerns within popular values and provisions were taken to intentionally rid the people of such ‘nuisance’. An early example of this creeping concern is the Factories Act 1833. [9]Victorians had mere appreciation of‘nuisance’. What would be considered as pollution in modern perspective was seen as an indicator of prosperity in Victorian Britain. [10] Nevertheless, public health concerns materialised in environmental ‘nuisance’ law. To illustrate, the Smoke Abatement (Metropolitan) Act 1853[11]provided for the control of the nuisances from smokes and vapours in the air – dangerous to human health. Similarly, the Alkali Act 1863[12] intended to place regulation on the condensing of corrosive Muriatic Acid in Alkali Factories – dangerous to public health; so as to limit its ‘nuisance’ to the public. Therefore, Victorian environmental law, despite being slow to recognise environmental significance, intended to limit the damage of these ‘nuisances’; more to the public that to the environment per se. Later, in common law, ‘mere nuisance’ transformed to actual concern for the environment itself. There was a change of opinion from tackling pollution that was already present, to trying to prevent the emergence of any new sources in the first place. As an example, the English Law, House of Lords case Rylands v Fletcher[13]will be examined. In this case it was established that if a man’s nuisances spread to another’s land, he would be strictly liable for the damage caused to the others land. Thus, these preventative measures established precedent to control citizens from creating new pollution through fear of civil action. In addition to this, the later House of Lords case of Hunter v Canary Wharf Limited[14] followed the ‘Rylands rule’ in that ‘nuisance’ (or pollution) would have legal causation to land damage only. Apparently so, this controlling intention in common law protected the environment from damage but was perhaps somewhat unfair to the private citizen in some cases. To illustrate this, if a man had suffered loss as a result of harm caused by another nuisance he would be unlikely to receive damages for example his property as in Canadian High Court case of Bottoni v Henderson. [15]Later, statutory reform wouldbe needed to proportionate and protect both environmental, as well as private interest. [16] Therefore, the purpose of environmental law developed to protective the environment more than the public as it once did in the past; despite perhaps being disproportionate in some circumstances. In post-war Britain this intention to protect the environmentcontinues[17]but, particularly after 1972 toward the principle of ‘sustainable development’;as defined by the Bruntland Report of 1987. [18] It is arguably the main purpose of environmental law today. [19]Perhaps an unsubstantiated claim, it has been argued that the principle in fact ‘†¦plac[es] human†¦ interests above†¦ environmental protection’;[20]overlooking that it intends tolimit the impact of human population on world ecosystems. [21] The Brundtland report has been criticised to say that its breadth is difficult to be incorporated into policy. [22]This is apparent in the UK up until around the mid 1990s. [23] Despite this, there has been significant intention to incorporate sustainable development; the Climate Change (Scotland) Act 2009 has done particularly well at this. [24] However, it should be asked how effective our sustainability policy really is. The Sustainable Development Commission – the policy advisor for the UK and Scottish Government is to be shut down. [25]Furthermore, this closure has been openly criticised by its commissioners. [26] The intention therefore of environmental law in modern Britain is to pursue sustainable development; all be it not realised yet in policy. In conclusion, the purpose of environmental law was once public protection, manifested by popular concern, gradually achieved through statue. The Freedom of Information Act

The Freedom of Information Act Prior to the enactment of the Freedom of Information Act (FOIA) in 1966, any person seeking non-public information from a U.S. federal  government agency had to first prove they had a legal need to know in order to view related government records. James Madison would not have liked that. A popular Government without popular information or the means of acquiring it, is but a Prologue to a Farce or a Tragedy or perhaps both. Knowledge will forever govern ignorance, and a people who mean to be their own Governors, must arm themselves with the power knowledge gives. James Madison Under the FOIA, the American people are assumed to have a right to know about their government and the government is required to prove a compelling reason in order to keep information secret. In other words, the FOIA establishes the presumption that records of the U.S. Government must be made accessible to the people. Also note that most state and local governments have adopted laws similar in intent and function to the FOIA.As soon as he took office in January 2009, President Obama issued an executive order directing the government agencies to approach FOIA requests with a presumption in favor of disclosure. The Government should not keep information confidential merely because public officials might be embarrassed by disclosure  because errors and failures might be revealed, or because of speculative or abstract fears, wrote Obama, stating that his administration would be dedicated to an unprecedented level of openness in Government. This guide is a simple explanation of how to use the FOIA to request information from the U.S. government agencies. But, please be aware that the FOIA and litigation involved with it can become extremely complex. Thousands of court decisions have been made regarding the FOIA and anyone requiring more detailed information about the FOIA should contact an attorney with experience in governmental affairs. Before Requesting Information Under the FOIA Look for it on the Internet. An incredible amount of information is now available on thousands of government websites, with volumes more being added every day. So before going to all the trouble of writing and sending an FOIA request, just log on visit the agencys website or run some searches. What Agencies are Covered by the FOIA? The FOIA applies to documents in the possession of executive branch agencies including: Cabinet agenciesMilitary branchesGovernment corporationsIndependent regulatory agenciesOther executive branch offices commissions The FOIA does NOT apply to: Any elected official of the US GovernmentOfficers of the federal Judicial Branch Private citizensPrivate companies or associationsGovernment contractors Government grant holdersState or local governments (most state and local governments have laws similar to the FOIA) While elected officials are exempt all daily actions of the United States Congress are published in the Congressional Record. You may, by mail, request and receive copies of any records in the possession of an agency except those covered by the following nine exemptions: Classified defense and foreign policy informationInformation prohibited from disclosure under other lawsInternal agency rules and practicesTrade secrets and confidential business practicesInter or intra-agency communications protected under lawInformation involving matters of personal privacyCertain information regarding law enforcementInformation on supervision of financial institutionsGeological information on wells In addition, especially sensitive information concerning law enforcement and national security issues may occasionally be withheld.Agencies are free to (and sometimes do) disclose information even though the records are exempted under the provisions above.Agencies may also disclose only parts of information while withholding exempted sections. Withheld sections will be blacked out and are referred to as redacted sections. How to Request FOIA Information FOIA requests must be sent by mail directly to the agency that has the records you want. There is no single government office or agency assigned to handle or route FOIA requests. While a few individual agencies currently provide for online FOIA request submittal, requests to most agencies must still be submitted via standard mail or email. Online FOIA requests to the agencies that currently accept them can be submitted on the FOIAonline.gov website. Addresses for submitting FOIA requests to all federal agencies can be found on the FOIA.gov website. Each agency has one or more official FOIA contact offices to which requests should be addressed. Larger agencies have separate FOIA offices for each bureau and some have FOIA offices in each region of the country.Contact information for the FOIA offices of just about all agencies can now be found on their website. The U.S. Government Manual is also useful for determining which agency has the records you want. It is available at most public an d university libraries and can also be searched online. What Your FOIA Request Letter Should Say FOIA information requests should be made in a letter mailed to the FOIA Officer of the agency. If you cant determine exactly which agency has what you want, send a request to each potential agency. You should also mark both the letter and the outside of the envelope, Freedom of Information Act Request to speed its handling by the agency. It is vital that you identify in the letter the information or records you want as clearly and specifically as possible. There is no initial fee required to submit an FOIA request, but the law does provide for the charging of certain types of fees in some instances. For a typical requester the agency can charge for the time it takes to search for records and for duplication of those records. There is usually no charge for the first two hours of search time or for the first 100 pages of duplication. You may always include in your request letter a specific statement limiting the amount that you are willing to pay in fees. If an agency estimates that the total fees for processing your request will exceed $25, it will notify you in writing of the estimate and offer you an opportunity to narrow your request in order to reduce the fees. If you agree to pay fees for a records search, you may be required to pay such fees even if the search does not locate any releasable records. You May Request that Fees Be Waived You may request a waiver of fees. Under the FOIA, fee waivers are limited to situations in which a requester can show that the disclosure of the requested information is in the public interest because it is likely to contribute significantly to public understanding of the operations and activities of the government and is not primarily in the commercial interest of the requester. Requests for fee waivers from individuals who are seeking records on themselves usually do not meet this standard. In addition, a requesters inability to pay fees is not a legal basis for granting a fee waiver. How Long Does the FOIA Process Take? By law, agencies must respond to FOIA requests within 10 working days of receipt. Agencies may extend this time if necessary, but they must send written notice of the extension to the requester. What if Your FOIA Request is Denied? Sometimes, the agency simply does not have or cannot locate the requested records. But if the records are found, only the information or parts of information exempted from disclosure can be withheld. If the agency finds and withholds any or all of the information, the agency must notify the requester of the reason and inform them of the appeals process. Appeals should be sent to the agency in writing within 45 days. The websites of most federal agencies include pages fully explaining the agencys specific FOIA process instructions including contact information, records available, fees, and appeals process.
